    NZ H&S agencies have never got over the atomic arseholing they got in respect of cave creek ,so they&ultimately the government are in a constant state of arse twiching penance and ferreting to avoid anything remotely similar. similarly the septic haemmarhoid ACC are too busy investing profits than doing what they should and paying out to people who have genuine injuries&claims.

    try this for size my younger brother drives a forklift.
    the other day at work he has a near miss with someone ,walking behind where he was driving /operating fuckin pc bollocks, toting some pallets.
    no biggie he thinks wasnt that close but his arse licking supervisor pots him and knowing that they both like the occasionel joint thru smoko conversation lands him right in it.
    test positive is enough to get him sent home presumembly till main test backs up he smoked 5 days ago.
    rediculiously enough they get someone to drive his car home even tho he drove to get to work so he,s off on full pay till the result comes back then they now get the right to test him 6 times anytime they want in the next 2 years .

    Utter rubbish on both counts. The health and safety legislation mainly changed to snare culpable parties like owners and directors who could hide behind companies and legal entities. This mainly arose from Pike. Plus, under the previous H&S Act work place injuries continued to rise.

    ACC invest profits in order to make payments to people who are entitled to them. On average, of the ACC decisions that are appealed to the Court less than 40% are won. That represents a very small minority of ACC decisions being incorrect. In order to be covered under the ACC Act you must be eligible. There are exclusions, and there is a considerable body of law supporting them. One of the main problems is that people simply do not understand the legislation.

    Just because a person pays ACC levies does not mean that they have automatic entitlement. If that was the case, the scheme would go broke in-spite of their investments. Not withstanding all of this, it is the best no-fault personal injury insurance in the world.

    The rules haven't changed much as I understand, as Thar says it's about who wears the can. Unfortunately legislation cant remove stupidity or stop cowboys but over-legislation slows everything down and frustrates most of us with more than two brain cells.

    So he fails a drug test that would have been in his employment contract. What's the issue?

    In my mind , he is lucky to have second chance. 6 tests over 2 years, I'm picking if he fails one he's out?
