    Ownership of Internet Domain names

    Someone may know answer to this

    Mate saw a product he liked in Aussie. Bought couple off their website. Liked it and asked to buy 100 units for friends family and maybe distribution. Got told ok here's yr price go for it
    So went and got the .co.nz web domain name plus the .kiwi one. It was suggested vie email that if he didn't t proceed they d like the domain names back in their possession but no papers ever signed etc.
    Aussies now wish to run with potentially larger distributor in NZ. They have threatened lawyers if he does not hand over at cost price the two domain names. They hold no patents in NZ at all

    I thought he should tell them to bugger off or ask for maybe a grand each

    Anyone know the rules as far as this goes ?

    I dont know the rules but know that some people made a lot of money buying up domain names (Like holden etc) before the big company's got their shit together and had websites,then they had to buy their own domain name off someone who had the forsite to buy em up.
    "Hunting and fishing" fucking over licenced firearms owners since ages ago.

    I'm not a lawyer but would be inclined to tell them to go jump,he owns them and probably has had to pay upkeep on them to keep them. As has already been said people used to make big $ doing it so find see why he couldn't charge a larger than cost price.

    I sold a couple 3 years ago for $650 each, but I didn't look into the legalities and nor do I think the other party did. Was a friendly transaction

    I think if they have the trademark in NZ, they have some rights to them, otherwise no way. I don't believe they have any leverage here.

    If he was just "squatting" on it, e.g. had bought it just to make a buck selling it back to them, then he'd possibly just have to hand it back, but he had every right to purchase it, he's used it legitimately, it's his. He can name his price or continue to hold onto it, and there's nothing they can do about it, is my understanding of the rules. (Assuming they have no relevant NZ trademarks.)

    Edited to add: he should probably talk to a lawyer, though. They should be able to tell him pretty quickly, and he can just cost that into the price he eventually charges them for the domains .

    Unless the law has changed in the last few years they do not have rights to the site names.
    Recommend setting a friendly price to compensate for your mates wasted time and them breaking their verbal agreement (I'm guessing there are a couple of emails to confirm the discussion anyway)
    He will also want written confirmation that they will buy back his stock at cost or cover all warranties if he sells them.
    Point out that if they use lawyers then the cost to them will be more that what it will cost to settle things this way.
    I would aim for $3-5k all up

    Think the advice here is correct, I have mountrewinds.co.nz, however I also have to cover .com etc. you have to keep them paid up, but think warned if they're about to expire. Just got happy.co.nz!

    That's my opinion as well, but he should counter sue for the stress etc.

    That's my thoughts as well, he should counter sue for stress.

    Pretty sure they have no legal rights to the domains.

    But your best option here is to seek legal advice.

    Do not under any circumstances enter into ANY correspondence of any form with these guys until you've got it ...

    Dunno the domain names or the "trade Marks" you're talking about so can't say much about it -

    Happy spoke to my mate last night , he says the domain names are his but could get messy if layers got involved . Best to try for selling them to them . He thought 2 to 5 k was not extortion . Especially if he was genuine with his venture as a distributer .
