    I have a firearm accident related hearing loss and ACC declined me too. Same reason given.

    The ringing hasn't stopped or improved at all in the 5 years since.

    ACC have really changed their attitude on hearing loss, had no problem 40 years ago getting my claim excepted plus re-assessments every 10 years. Now suddenly don't want to look back at my past records, has become 84% hereditary, 16% damage. Case manager is always on "stress leave," they rely on you finally giving up.

    Very lucky indeed.
    The bolt looked like it was all the way forward and closed but it obviously wasn't locked. When I pulled the trigger it fired the shell regardless which should not be possible in a modern gun.

    Any reputable shop should not hesitate to assist. After all its there reputation. Maybe the gun has been parallel imported etc. And they maybe out of there rights to import it etc. Had you injured yourself seriously then they would be up for a investigation from police. Of they are un cooperative then just name and shame them. They would lose more than 700 of businesses thru social media post ls alone.

    It is there best interest to help you out. I would contact the importer direct. But like others have said hold on to the gun.

    now kotuku had one where he hadnt seated the barrel right after camo tapeing it that frightened the shit out of 3 of us .
    snap a 20 gauge diamond righthanded semi blew up in mine.
    apparently a notch wasnst machined right??
    blew across my face and took out my right ear got as high as 9.9%loss but that aint ten.
    acc been running an americaised get out of paying hearing scam for years cos theyd be up for multi millions if they had to pay out on industrial hearing loss alone.
    they will pay for your hearing aids tho and batteries.
    take lots of pictures and get a report from a gunsmith which the agent can reimburse you for

    Similar thing happened to a friend about 12 years ago with a brand new Escort 3.5" magnum. We tried out his new gun a few weeks before opening, only fired a few rounds before turning into a single shot. Noticed a few shells had damage to the heads. Took back to H&F, owner angry and unpleasant about it but took it to get "fixed" My mate really wanted a refund- no go. Got the gun back just before the big day, opening morning, 1st shot, big bang and ripped the head off the shell. Using 2-3/3" lead from memory. Very pissed off he was!. Anyway went back to the retailer on Monday and he offered to get it looked at again! We had very carefully examined the gun and found that yes, it could be fired in an unlocked state. He would not accept this as possible. Using printed pages from the CGA, I pointed out that he had already had a chance to remedy the problem and failed and because it was a safety matter, my friend was now within his rights to demand an immediate refund. The retailer wrote him a check with much bitterness and mumbled cursing. Nasty bloke.
    Since there is probably no way to sue anyone about it, a full refund would be your best outcome. Push for that using the stipulations under the CGA. There were a lot more problems with the earlier escort shotguns than was let on, I remember seeing around 200 receivers sold on Trademe for scrap metal after being replaced under warranty. Escorts are just sluts we used to say.

    all i can say not knowing your circumstanes is get specialist referal and get them to write a report detailing your hearing loss and the cause.i dont think theres a time that you cant appeal thier mistakes
    but get specialist advice and report as soon as your accident allows.
    tell gp its acc and you want specialist referals as soon as possible after any accident.
    if your dealing with that eon pack of c..ts good luck to you that private acc pack of bastards are the mob that if you lost a body part they,d still make you wait three months untill they had written proof.
    they work for the meatworks talleys etc enough said.
    but i beat those pricks with a scathing top orthapedic surgeons letter report a lawyer seeking costs and a mention of le fair go. the bastards caved in 3 days
    Escorts are just sluts we used to say.

    Purchasers should realise that generally, you get what you pay for. Turkish guns are cheap. Having said that, they are much better now than they used to be 20 years ago when the Turks were just getting into the international market. Parts breakages were common then due to poor metal choice but they seem to be on top of it now. Most of their guns are based on proven designs (Beretta, Benelli, etc) and generally display good quality machining, but no gun should be sold that is unsafe to use.

    The comments about the Escorts are quite appropriate! When I was in business I refused to work on Escort shotguns after repairing a few. I don't have any experience of the other variety!

    Has the retailer shown you the email from the Importer/Distributer to prove that it does have to be dealt with through the dealer?

    One consideration is that that part of it could be genuine, in many transactional situations the buck stops with the party that receives the money for the product/service. For example when it comes to couriers, if you are expecting a bought parcel and it doesn't arrive, by rights the issue should be taken up with the sender of the parcel as they were the one you paid for the product. They had the responsibility to ensure delivery of the product and it is therefore their issue to raise with the courier who the sender chose and paid to deliver the product. The courier has no real direct liability to you the receiver of the parcel because you never paid the courier directly for their service.

    Given the behaviors of the dealer thus far against the gravity of what has happened however, it would be advisable to restrict all communication to written only.
    It doesn't seem unreasonable to ask that the importer be copied in on the communication unless the dealer and/or importer can provide a robust reason to the contrary.

    It’s a hard one because if you brought it 2nd hand no warranty Exists it’s hard to get anything as it was functioning fine for 1000 rounds or more

    Definitely independent gunsmith 1st port of call
    Also look at the ammo Is that is also a possible Cause
